ANSWER

There are several pathways which may be available to you to resolve the matter:

  1. Provided you feel comfortable doing so, you can try to resolve the issue directly with the person(s) involved where appropriate.
  2. If you do not feel comfortable doing so, you can try to resolve the issue through discussion with your supervisor or more senior levels of management (if any).
  3. Depending on the nature of the mistreatment, you may be able to invoke (and in that case, must follow) the dispute resolution processes at clauses 18 and 19 of the NTCER. At a high level, these processes apply where there is a dispute about a matter in relation to the National Employment Standards in the Fair Work Act (clause 18), or the terms of the NTCER which do not relate to the National Employment Standards (clause 19).
  4. You may be able to take legal action. You should attempt to resolve the dispute and seek legal advice and assistance from a lawyer first before commencing legal action.

At any time, you can seek support or assistance from a person, organisation or association of your choice including but not limited to, GPRA, your training provider or your Registrar Liaison Officer.
