ANSWER

Per clause 6.10 of the NTCER, registrars who normally work ordinary hours on a day on which a public holiday falls are entitled to that public holiday as paid leave.

If a registrar works on a public holiday, then the registrar will receive:

  • their normal pay and equivalent time off in lieu, which will be paid at their base rate of pay; or
  • 150% of their normal pay, and no time off in lieu.

The above assumes a registrar’s total salary in an agreed cycle is their base rate of pay (and not a billing percentage).

Where a registrar’s billing percentage exceeds their base rate of pay (as increased by the amount of any applicable penalty rates) in an agreed cycle, then the registrar will be paid the applicable billing percentage and is not entitled to additional payment beyond this amount in an agreed cycle on account of the public holiday.
